The recreational exception is narrower than people think — and getting it wrong is expensive. The FAA's own guidance is blunt: when in doubt, assume Part 107.
One paid photo. One clip on a monetized channel. One shot for the business. That's not recreational anymore — it's Part 107, full stop. Posting "for fun" is fine; the second there's income or business intent, you need the cert.
Civil penalties run up to $75,000 per violation under the 2024 FAA Reauthorization Act. In 2025 the FAA fined 18 operators between $1,771 and $36,770. In every one of those cases, the operator had no Part 107 and no registration.
Not having a certificate doesn't protect you — the FAA fines unlicensed operators directly, and flying without a cert just adds another violation on top of whatever else happened.
The FAA updated its policy — legal action is now the default response for serious violations, not a friendly compliance chat. And the public is being encouraged to report unsafe operators.
Recreational registration is $5. Part 107 registration is another $5 — they're separate registration types. Register recreational now, then commercial later, and you've paid $5 twice for the same drone. Skip the detour. Go straight to Part 107 and register once.
